These Terms of Use (“Terms”) govern your access to and use of the Coach Financing Solutions website, financing platform, products, services, software, applications, and related features (collectively, the “Platform”).

By accessing or using the Platform, submitting information, creating an account, requesting financing options, or participating as a client, coach, consultant, educational organization, lender, or other user, you agree to be legally bound by these Terms. If you do not agree with these Terms, please do not access or use the Platform.

These Terms create a legally binding agreement between you and Coach Financing Solutions regarding your use of the Platform.

1. About Coach Financing Solutions

Coach Financing Solutions is a technology platform that helps connect individuals seeking financing for eligible coaching services, consulting engagements, certification programs, educational courses, mastermind groups, retreats, and other qualifying professional development services with participating lending partners and financing providers.

Coach Financing Solutions does not originate loans, make lending decisions, extend credit, guarantee financing approval, or provide financial, legal, tax, or investment advice.

Our Platform is designed to simplify the financing process by allowing prospective clients to explore available financing options while enabling coaches, consultants, academies, educational organizations, and training providers to offer financing opportunities through participating lending partners.

Any financing product displayed through the Platform is offered solely by the applicable lender or financing provider, which is independently responsible for underwriting, approval decisions, loan disclosures, funding, servicing, collections, and compliance with applicable lending laws.

2. Eligibility

To use the Platform, you represent and warrant that:

  • You are at least 18 years of age.
  • You have the legal authority to enter into binding agreements.
  • All information you provide is truthful, accurate, and complete.
  • You will promptly update any information that becomes inaccurate.
  • Your use of the Platform complies with all applicable federal, state, and local laws.

If you are using the Platform on behalf of a coaching business, consulting firm, academy, corporation, partnership, educational institution, or other organization, you represent that you have authority to bind that entity to these Terms.

3. Our Services

Coach Financing Solutions provides technology designed to facilitate connections between clients, coaches, educational organizations, and participating lending partners.

Depending on the services available at the time, the Platform may allow users to:

  • Explore financing options for eligible coaching services and educational offerings.
  • Submit financing requests or prequalification inquiries.
  • Connect with participating lending partners.
  • Allow coaches and education providers to offer financing to prospective clients.
  • Track financing activity through available account features.
  • Receive communications regarding financing applications or account activity.

The specific services available through the Platform may change at any time without prior notice.

Nothing on the Platform constitutes an offer to lend money or a commitment that financing will be available.

4. No Lending Relationship

Coach Financing Solutions is not a bank, finance company, lender, loan broker, credit union, or licensed lending institution unless expressly stated otherwise.

We do not:

  • Approve or deny financing applications.
  • Determine interest rates.
  • Set repayment terms.
  • Issue credit decisions.
  • Fund loans.
  • Service loans.
  • Collect loan payments.

Financing decisions are made exclusively by independent participating lending partners based on their own underwriting standards.

Any prequalification offered through the Platform is informational only and should not be interpreted as a guarantee of final approval or funding.

Loan availability, eligibility, repayment terms, interest rates, fees, and other financing conditions are determined solely by the participating lender.

5. Coach & Business Participation

Coaches, consultants, academies, educational organizations, and other businesses using the Platform are solely responsible for:

  • Maintaining all required business licenses, registrations, and certifications.
  • Complying with applicable consumer protection laws.
  • Providing truthful and accurate information regarding their business.
  • Accurately representing their coaching services, consulting engagements, certification programs, retreats, mastermind groups, courses, pricing, and other offerings.
  • Obtaining any required client authorization before submitting financing requests.
  • Following all lender program requirements applicable to their participation.

Participation on the Platform does not create an employment relationship, agency relationship, partnership, joint venture, or franchise between Coach Financing Solutions and any participating business.

We reserve the right to approve, suspend, restrict, or terminate business access to the Platform at our sole discretion.

6. Client Use

Clients may use the Platform to explore financing opportunities for eligible coaching services, consulting engagements, educational programs, certification courses, mastermind groups, retreats, and related professional development offerings.

By submitting information through the Platform, you authorize Coach Financing Solutions and participating lending partners to review the information you provide for the purpose of determining available financing options.

Submitting a financing request does not obligate you to accept financing, enroll in any coaching service, or enter into an agreement with any coach, educational organization, or lender.

Likewise, submitting information does not guarantee financing approval or the availability of financing offers.

Clients remain responsible for reviewing all loan disclosures, repayment obligations, interest rates, fees, privacy notices, and contractual terms provided directly by any participating lender before accepting financing.

7. Account Registration

Certain features of the Platform may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated as needed.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

If you believe your account has been accessed without authorization, you should notify Coach Financing Solutions immediately.

We reserve the right to suspend or terminate accounts containing false information, duplicate accounts, fraudulent activity, or conduct that violates these Terms.

8. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms.

When using the Platform, you agree that you will not:

  • Submit false, misleading, or inaccurate information.
  • Attempt to impersonate another individual or business.
  • Access accounts or information belonging to another user without authorization.
  • Upload malicious software, viruses, malware, or other harmful code.

Coach Financing Solutions may investigate suspected violations and take any action deemed appropriate, including suspending or permanently terminating access to the Platform.

9. Third-Party Financing Partners

Coach Financing Solutions works with independent lending partners, financing providers, and technology partners to help facilitate financing opportunities for eligible coaching services, consulting engagements, certification programs, educational courses, mastermind groups, retreats, and other qualifying professional development services.

These third parties operate independently from Coach Financing Solutions and maintain their own approval criteria, underwriting guidelines, loan products, disclosures, privacy practices, and customer agreements.

Coach Financing Solutions does not control or guarantee:

  • Loan approval decisions
  • Interest rates
  • Monthly payments
  • Repayment terms
  • Funding timelines
  • Credit limits
  • Promotional financing offers
  • Customer service provided by lenders

Any agreement entered into between you and a participating lender is solely between those parties. You are responsible for reviewing all applicable disclosures and contractual documents before accepting any financing offer.

10. Accuracy of Information

You certify that all information submitted through the Platform is accurate, complete, and truthful to the best of your knowledge.

Providing false, incomplete, or misleading information may result in delayed processing, denial of financing opportunities, suspension of your account, or permanent removal from the Platform.

Coach Financing Solutions reserves the right to request additional information or documentation to verify identities, business information, enrollment details, coaching service information, or other information submitted through the Platform.

11. Communications and Electronic Consent

By using the Platform, you consent to receive communications electronically, including emails, text messages, notifications, and other communications related to your account, financing requests, customer support, or Platform updates.

Electronic communications satisfy any legal requirement that communications be provided in writing.

You may opt out of certain marketing communications at any time; however, transactional or account-related communications may continue as necessary to provide our services.

Message and data rates may apply if you choose to receive SMS communications through your mobile carrier.

12. Intellectual Property

The Platform, including its design, layout, software, graphics, logos, trademarks, service marks, text, images, videos, functionality, content, and other materials, is owned by or licensed to Coach Financing Solutions and is protected under applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

  • Sell, license, lease, or commercially exploit any portion of the Platform.
  • Remove proprietary notices or branding.

Any information, reviews, comments, feedback, coaching business information, enrollment information, application details, service descriptions, or other content you submit through the Platform remains your responsibility.

By submitting content, you grant Coach Financing Solutions a non-exclusive, worldwide, royalty-free license to use, reproduce, display, modify, publish, and distribute such content as reasonably necessary to operate, improve, market, and maintain the Platform.

You represent that you own or have the necessary rights to submit any content you provide and that doing so does not violate the rights of any third party.

We reserve the right, but not the obligation, to remove any content that we believe violates these Terms, applicable law, or the rights of others.

14. Platform Availability

We may modify, suspend, discontinue, or replace any feature, financing partner integration, or functionality of the Platform at any time without prior notice.

Coach Financing Solutions does not control, endorse, or assume responsibility for the content, security, privacy practices, availability, or services provided by any third-party website or service.

Your interactions with third-party websites, lenders, coaches, educational organizations, or service providers are governed solely by their respective terms, conditions, and privacy policies.

16. No Professional Advice

Information available through the Platform is provided solely for general informational purposes.

Nothing on the Platform should be interpreted as financial, legal, tax, accounting, insurance, investment, business, or professional advice.

Coach Financing Solutions does not provide coaching services or educational instruction and does not recommend any particular coach, course, certification program, lender, financing product, or educational provider.

You should consult qualified professionals before making financial decisions, enrolling in coaching services, or entering into financing agreements.

Coach Financing Solutions does not guarantee that any financing product is suitable for your individual financial circumstances or objectives.

17. Disclaimer of Warranties

The Platform and all related services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, Coach Financing Solutions disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation.

We do not warrant that:

  • The Platform will always be available or operate without interruption.
  • Financing options will be available for every applicant.
  • Any lender will approve a financing request.
  • Any financing offer presented through the Platform will remain available.
  • Any coach, consultant, academy, or educational organization will provide services as represented.
  • Information displayed on the Platform will always be complete, current, or accurate.
  • The Platform will be free from viruses, malware, or other harmful components.

Your use of the Platform is entirely at your own risk.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Coach Financing Solutions, its owners, affiliates, officers, employees, contractors, licensors, technology providers, participating partners, and service providers shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages arising out of or relating to your use of the Platform.

This limitation includes, without limitation, damages related to:

  • Loss of business opportunities
  • Loss of goodwill

  • Financing decisions made by participating lenders
  • Delays in funding
  • Coach performance
  • Consulting services
  • Certification programs
  • Coaching packages

If Coach Financing Solutions is found liable for any claim arising from your use of the Platform, our total liability shall not exceed the greater of one hundred dollars ($100) or the amount you paid directly to Coach Financing Solutions for the specific service giving rise to the claim during the twelve (12) months preceding the event.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, portions of this section may not apply.

19. Indemnification

You agree to defend, indemnify, and hold harmless Coach Financing Solutions, its affiliates, officers, employees, contractors, licensors, technology providers, and partners from and against any claims, liabilities, damages, judgments, losses, costs, or expenses, including reasonable attorneys’ fees, arising from or relating to:

  • Your violation of applicable laws or the rights of another individual or business.

This obligation survives the termination of your use of the Platform.

By using the Platform, you acknowledge that you have reviewed our Privacy Policy and consent to the collection, use, disclosure, and handling of your information as described therein.

21. Suspension and Termination

We are under no obligation to maintain any specific feature, financing partner, lender relationship, product offering, integration, or functionality.

Coach Financing Solutions may also introduce new features or discontinue existing services at its sole discretion.

23. Changes to These Terms

Coach Financing Solutions may update these Terms from time to time to reflect changes in our services, technology, legal requirements, participating lending partners, or business practices.

When material updates are made, we will revise the Effective Date appearing at the top of these Terms.

Your continued use of the Platform after updated Terms become effective constitutes your acceptance of the revised Terms.

If you do not agree with any revised Terms, you must discontinue using the Platform.

24. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any legal action or proceeding arising from or relating to these Terms or your use of the Platform shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction and venue of those courts.

25. Dispute Resolution

Before initiating formal legal proceedings, both parties agree to make a good-faith effort to resolve any dispute through informal discussions.

If a dispute cannot be resolved informally, either party may pursue any remedies available under applicable law in a court of competent jurisdiction unless another written agreement between the parties requires arbitration.

Nothing contained in these Terms prevents either party from seeking temporary injunctive, equitable, or other emergency relief where permitted by law.

26. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Any invalid provision shall be interpreted as closely as possible to reflect its original intent while remaining enforceable under applicable law.

27. Entire Agreement

These Terms, together with our Privacy Policy and any additional policies, disclosures, or agreements expressly incorporated by reference, constitute the entire agreement between you and Coach Financing Solutions regarding your use of the Platform and supersede all prior communications, negotiations, representations, or understandings relating to the subject matter herein.

28. No Waiver

Failure by Coach Financing Solutions to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right under these Terms.

Any waiver must be in writing and signed by an authorized representative of Coach Financing Solutions.

No delay or partial exercise of any right or remedy shall prevent the future exercise of that or any other right or remedy.
